Promotional Terms & Conditions

These Promotional Terms & Conditions (“Offer Terms”) govern participation in the California 2026 Compliance Offer (the “Offer”) provided by 365 Kitchen Management, powered by Kafoodle (“Company”, “we”, “us”).

By signing a subscription agreement under this Offer, you agree to these terms in addition to the Company’s standard Master Subscription Agreement.

1. Offer Eligibility

1.1 The Offer is available only to food service businesses:

  • Located in the State of California, United States; and
  • Operating within the food service or hospitality sector; and
  • Not currently subscribed to 365 Kitchen Management or Kafoodle.

1.2 The Company reserves the right to verify eligibility and decline participation at its discretion.

2. Offer Period

2.1 The Offer is available for agreements signed on or before July 1, 2026.

2.2 Agreements signed after this date will not qualify for promotional pricing or free access under this Offer.

3. Promotional Benefit

3.1 Eligible customers will receive:

  • Access to the core 365 Kitchen Management system, powered by Kafoodle, free of charge for a period of three (3) months prior to July 1, 2026.

3.2 Billing for paid services will commence on July 1, 2026, regardless of the date of system activation, unless otherwise agreed in writing.

3.3 The free access period has no cash value and is non-transferable.

4. Minimum Contract Commitment

4.1 Participation in this Offer requires a minimum subscription commitment of twelve (12) months.

4.2 The twelve-month term will commence on July 1, 2026.

4.3 Early termination during the initial term may result in payment of the remaining subscription balance, in accordance with the Master Subscription Agreement.

5. Payment Terms

5.1 Subscription fees may be paid:

  • Annually in advance; or
  • Monthly via GoCardless (or approved payment method).

5.2 All subscription fees beginning July 1, 2026, will be charged upfront in accordance with the selected billing structure.

6. Services Included in the Offer

The Offer includes access to:

  • Core 365 Kitchen Management system (Recipe & Menu Management)
  • One (1) interactive menu for one primary (head office) location
  • One (1) one-hour onboarding session
  • One (1) ingredient and recipe data import
  • Access to chatbot support and the support article database

7. Services Not Included

The following are not included within the promotional package and may incur additional charges:

  • Additional onboarding sessions
  • Multiple site menu configurations
  • Food labeling module
  • Carbon emission labeling module
  • Stock & Ordering module
  • Meal Planning module
  • Person-centred meal ordering module
  • Additional recipe imports
  • Additional supplier integrations
  • Additional interactive menus

8. Additional Costs

Additional services may be purchased at the following rates:

  • Additional interactive menus – priced per site
  • Assisted onboarding package – $1,100 (one-time fee at signature), including:
  • One additional hour of training
  • One mapping session
  • Setup of one (1) main supplier with unlimited ingredient SKUs
  • Additional training – $150 per hour
  • Recipe imports – $60 per recipe
  • Labelling module – $10 per month per site
  • Stock & Ordering – $20 per month
  • Setup for one main supplier – $250
  • Non-integrated supplier setup – $450
  • Additional sites:
  • Head Office Site – $100/month (mandatory per account)
  • Read-only Site – $10/month per site
  • Kafoodle Kitchen Site – $20/month per site

All prices are exclusive of applicable taxes.

9. Implementation & Data Responsibility

9.1 The customer is responsible for ensuring that all ingredient, recipe, and allergen data provided for import is accurate and up to date.

9.2 The Company is not responsible for inaccuracies in customer-supplied data.

9.3 Additional data cleansing or restructuring services are not included unless purchased separately.

10. Modifications & Termination

10.1 The Company reserves the right to modify or withdraw this Offer at any time prior to contract signature.

10.2 Once a subscription agreement is executed, the promotional terms remain valid for that agreement.

11. General

11.1 This Offer cannot be combined with any other promotion unless explicitly agreed in writing.

11.2 In the event of a conflict between these Offer Terms and the Master Subscription Agreement, the Master Subscription Agreement shall prevail.
